KINGS MILLS - OH   - Salmonella

By Daniel Bingamon

These are my opinions and details of this event that happened to me.

Back in December 2006, I was experiencing pain on the right mid abdomen area and diarrhea.  All the symptoms at the doctors office indicated something with gall bladder.   I got some medicine and few weeks went by and pain subsided, diarrhea turned into constipation after awhile.  Then in late January it all happened again, so I once again went to the doctor and they scheduled an ultrasound.  It found nothing.   While waiting for the test results, we heard on TV about the Peter Pan Peanut Butter.  I told my wife to quickly bring the peanut butter from the kitchen.  It was a matching lot number - (too bad it wasn't a lottery ticket).  I all made sense for I had a peanut butter sandwich twice and each time I experienced pain later.

I did some research on the Internet about it and was thinking that it would be nice to get reimbursed for those medical bills.  My doctor recommended a gastroenterologist and I found a law firm online that dealt with food contamination cases.   I thought it was bad what Con-Agra foods had done letting this thing happen - but I have to say that the law firms that deal with cases like this are far more guilty.  They were on the  west coast (in state of Washington), but I will not mention their name in fear that they might abuse their power on me.

They sent me a bunch of confusing forms to fill out, so I did.   No one ever asked me for a stool sample, no one ever asked for my container of peanut butter to test.   This was darn curious but I figured that they knew what they were doing and were just busy with many others.   Well, some time in the summer (maybe it was August or later), I wrote an email to them saying that I still had the peanut butter sample and received some gobbledygook message that the federal government had taken over the case.  Had no idea what that means and it didn't answer my question.

I recently within the past month (February-March 2008) received a letter stating that there was nothing they could do for me, no stool sample and that I didn't have my peanut butter anymore.  Well, that's a lie, they got little nervous when I sent them a copy of that earlier email and informed them that I still have the peanut butter today.    Now, they are offering to test it - probably to get rid of the evidence of their bumbling.

In my own personal opinion, I think they take on just enough clients to make themselves rich and throw out any excess.  Even if they seem legitimate, don't find someone on the internet - ignore their years of experience.  If you have an illness caused by food, don't contact these class action lawyer.   In my opinion, they're just shysters.   Get your own local lawyer, they can check Bar records of others and refer you if needed.   And maybe, it might be better to contact the food company if you can't afford a lawyer.

As for that legal firm, I'm finished with them.  They have wasted my time and I'm finishing up on paying for the Ultrasound test.

I still have that peanut butter, maybe I'll just write Con-Agra and get it exchanged.
